Senate Judiciary Committee Chairman Chuck Grassley (R-IA) has released FBI whistleblower records revealing that an anti-Trump FBI agent was behind former Special Counsel Jack Smith’s 2020 case against President Donald Trump. Grassley first disclosed the whistleblower’s existence on Thursday during the Senate Judiciary Committee’s confirmation hearing for Trump’s FBI director nominee, Kash Patel.

According to internal emails obtained by Fox News, a DOJ whistleblower alleged that an anti-Trump agent violated protocol and played a crucial role in opening and advancing the FBI’s 2020 election-related investigation, linking Trump to the probe without sufficient justification. The case, initially opened by the FBI on April 13, 2022, was internally referred to as “Arctic Frost,” as confirmed by documents shared with both Grassley and Sen. Ron Johnson (R-WI).

Grassley and Johnson claim these documents show that FBI Assistant Special Agent in Charge Timothy Thibault was the original source of Smith’s case against Trump. Thibault, who was later fired from the FBI for violating the Hatch Act, is accused by multiple whistleblowers of allowing partisanship to influence investigations involving both Trump and Hunter Biden.

A February 14, 2022, email reportedly shows Thibault instructing a subordinate agent, writing, “Here is draft opening language we discussed,” and attaching text that would later be used in Smith’s elector case. In another email on February 24, 2022, Thibault allegedly told John Crabb, a prosecutor in the U.S. Attorney’s Office for the District of Columbia, that “we believe there to be predication to include former President of the United States Donald J. Trump as a predicated subject.”

Sources confirmed to Fox News that Thibault lacked the authority to open criminal investigations since he was not a special agent, yet he proceeded with the case against Trump anyway. A third email on the same day purportedly reveals Thibault stating that he would seek approval from Attorney General Merrick Garland and FBI Director Christopher Wray to formally open the investigation.

On February 25, 2022, a subordinate agent, Michelle Ball, sent Thibault an email confirming that Trump and others had been added as criminal subjects to the case. Thibault responded, “Perfect.”

Another email from April 11, 2022, reportedly shows Thibault approving the official opening of “Arctic Frost.” Two days later, an FBI agent notified Thibault that the bureau’s deputy director had approved the case’s launch. Thibault then informed Crabb of the approval, prompting the DOJ official to respond, “Thanks a lot. Let’s talk next week,” according to Fox News.

During Patel’s confirmation hearing on Thursday, Grassley highlighted further details, stating, “Between March 22 and April 13, other versions of the document opening the investigation existed, because a ninth email shows that the FBI General Counsel’s office made edits on March 25.” He then questioned, “Was Trump still removed as an investigative subject? If so, which Justice Department and FBI officials—other than Jack Smith—later added him for prosecution?”

The whistleblower emails also suggest that Richard Pilger, a DOJ official in the department’s Public Integrity Section, reviewed and approved “Arctic Frost,” enabling the DOJ to escalate the matter into a full criminal and grand jury investigation. This case later evolved into Smith’s elector case against Trump.

Grassley previously raised concerns about Pilger’s DOJ record in a 2021 report, warning of potential bias. The following year, Grassley and Johnson raised alarms that Smith was overseeing an investigation that had been allegedly flawed from the outset, with his former subordinate, Pilger, involved in its opening.
